We invite you to keep a date with our team in Lagos (at the side lines of NIMS 2021) or remotely via Zoom for a live breakfast panel session addressing Legal Issues Affecting Cargo Claims and Ship Arrest in Nigeria.

We will commence by giving an overview of some legal issues that affect cargo claims in Nigeria. The session will proceed to explore a scenario involving the shipment of goods used as security for a loan, in which the bank is the consignee and the borrower, the Notify Party. The scenario will review arising incidents in the event the actions (or inactions) of the Nigerian Customs Service frustrate the ability of the Notify Party to perform the contract for which the loan was taken. These include liability for demurrage, storage charges, lost earnings and even arrest of the carrying ship. The right of suit on the cargo claims as well as the propriety of proceeding on any or all of the highlighted claims in admiralty will also be explored.
